The British national was sentenced to 30 years in prison.An appeals panel overturned the verdict this month, citing judicial and prosecutorial missteps, and sent the case back to the lower court for a new trial. Now, the prosecution is appealing the ruling to the state Supreme Court."We have 30 days to file the petition," said Peter Aseltine, a spokesman for the attorney general's office, which will handle the appeal.The decision to appeal was made in consultation with the Burlington County Prosecutor's Office, which tried the case in 2009, Aseltine said Tuesday.Typically, the high court will spend three to five months deciding whether to take on the case, he said."There is not a lot of evidence connecting this lady to the murder," said deputy public defender Kevin Walker, whose office will represent Dow if she is given a new trial. Dow, 53, was recently transferred from the Edna Mahan Correctional Facility in Clinton to the Burlington County Minimum Security Facility in Pemberton to await proceedings.No weapon was retrieved after the murder, and her fingerprints were not found at the scene. Also, the appellate panel said, no "incriminating physical evidence" was found at Dow's Maple Shade apartment, where police found her three days after the murder, lying unconscious on the floor next to pill bottles and a suicide note.Instead, the rambling suicide note became a critical piece of evidence at trial, used to show Dow's feelings of guilt and her wish to avoid prosecution.The appeals panel, however, found that the use of the note was prejudicial, saying the judge had failed to instself storageuct the jurors on how to evaluate it, especially since Dow had tried to commit suicide two other times.Superior Court Judge Patricia LeBon should have told the jurors that they could not view the suicide attempt as evidence of guilt if there were other credible explanations for Dow's actions, according to the appeals panel.The other suicide attempts were not brought up at trial."We have serious doubts that the jurors' verdict would have been the same if this evidence was excluded or admitted with instruction on its proper use," the panel wrote in its 13-page decision.The note, addressed to Dow's two close friends, said: "I have gone away to get away from Mike. He is a drunk and beats me every time I try to leave."The note also said that a former boyfriend was going to find someone to go after Mike to "fix him," and gave instructions for her burial.This note was the only one "of any significance in the trial," said Joel Bewley, spokesman for the prosecutor's office.The appeals panel also found that Assistant Burlington County Prosecutor John Brennan had misrepresented the significance of DNA evidence recovered from the victim's bloodstained shirt.The "mixed" DNA that was found was not an exact match with Dow's, and a forensic expert testified that she could not say "with a reasonable degree of medical certainty" that any of it came from Dow.But the expert went on to say that Dow's DNA was similar enough to the sample that she could not be excluded as a potential suspect. Source: Inland Valley Daily Bulletin, Calif.迷你倉Aug. 28--SAN BERNARDINO -- The probation revocation hearing for a former high school wrestler convicted of having unlawful sex with two teenage girls was continued so a judge could review the case.Judge Arthur Harrison had sentenced Seth Whisner, 20, to five years of probation after the defendant accepted a plea bargain in June.Whisner was released from custody on June 10, but re-arrested on July 25 for allegedly violating his probation.Now Judge Vic Stull, who is not yet familiar with the case, will take time to look over the file and decide who will make a ruling on the alleged violation, Deputy District Attorney Simon Umscheid said."The judge is not going to make a decision on a probation issue without knowing the case," Umscheid said after the hearing Tuesday at the San Bernardino Superior Court.Whisner, in custody without bail, has pleaded not guilty to the allegations. He is scheduled to be back in court on Sept. 20 where Stull is expected to decide what to do about judge appointment and probation revocation.Whisner was originally arrested April 16 after an investigation revealed he had unlawful sex with six teenage girls over a four-year period, the youngest alleged victim being 13. But the statute of limitations precluded prosecutors from charging Whisner for crimes involving four of the victims, Umscheid said.Whisner served nearly two months in jail before he signed a plea agreement on June 7. He pleaded guilty to one felony count of having unlawful sex with a girl three years younger than himself, a 15-year-old student at Rim of the World High School in Lake Arrowhead, and one misdemeanor cou自存倉t of having unlawful sex with a girl two years younger than himself -- a 17-year-old.Whisner was a former standout Lake Arrowhead wrestler who came back to Rim of the World as a volunteer coach.During Whisner's sentencing on July 23, Harrison ordered him, as one of the terms of his probation, to have no social media accounts including Facebook, Twitter and Instagram. ■熱點縱橫日前，迷你倉麻湧政府對自建房發出了最後的通牒：10月1日後，各村（社區）要嚴格禁止私人房建設，引導村民通過購買農民公寓或商品房解決住房問題。當前，麻湧政府有初步計劃建設較大量的農民公寓以解決戶籍人口居住問題。不過，其計劃尚未最終敲定。分析人士稱，叫停自建房短期內對麻湧樓市不會有太大促進，而長期的正面影響是必定的。短期內樓市客戶被分流早在2004年10月，東莞出台了《關於加強我市村居民公寓規劃建設管理的通知》，叫停了單家獨院式民宅的審批，全面禁止建獨院式私房，引導探索農民公寓建設。不過，麻湧的自建房卻並未停步。日前，麻湧鎮規劃房產管理所印發《關於限期建設私人房的緊急通知》對自建房發出了最後的通牒，10月1日之後禁止私人房建設。8月23日，筆者到麻湧鎮踩盤瞭解叫停自建房對麻湧樓市的影響。當前，麻湧只有大步海濱花園三期、信鴻熙岸花園等兩個項目在售，另有碧水灣花園等待發售。筆者在麻湧踩盤時看到，麻湧鎮中心及附近區域，三四層樓高的私人房鱗次櫛比，而商品房項目卻屈指可數。業內人士說，當前，麻湧原住民大多住在自建房中，在麻湧購房多為新莞人或廣州人。信鴻熙岸花園的售樓員說，在該項目購房的大多是在麻湧大企業就業的新莞人或在相鄰的廣州經濟開發區就業的人，本地戶籍的客戶比較少。據筆者踩盤獲悉，當前，麻湧商品房的訪客、買家中的原住民比例未有明顯增加。相反，由於自建房即將停建，部分原本購買商品房的原住民反而打消了購買計劃，轉向回家蓋自建房。大步海濱花園三期的一位售樓員說：“早前有一位在我們這裡有意向購房的客戶，聽到10月後就禁止自建房的消息後，就不買房了，回家蓋房去了。”筆者在麻湧踩盤時看到，的確有一些私人房正在趕工之中。長期帶動樓市發展禁止自建房，意味著以後麻湧的原住民要解決住房問題，主要依靠農民公寓和商品房這兩條途徑。意即，停建私人房能否帶動商品房市場的發展，主要看農民公寓的建設情況。麻湧鎮宣傳教育文體局副局長韋海良說，麻湧政府已經計劃在全鎮範圍內建設一批農民公寓，預計能夠滿足全鎮戶籍居民的實際需求。目前農民公寓建設規劃圖已經初步完成，幾個建設點也基本確定下來，有關部門正在整理送審資料，一旦獲批，則會馬上動工。據這一說法，農民公寓這一項目目前還處於計劃階段，是否能夠落實還有待觀察。對於叫停自建房與商品房市場的關係，東莞市博文道營銷策劃有限公司總經理楊波說，自建的私人房比商品房便宜很多，並且空間感大，所以過去麻湧原住民對商品房的需求不大，這是麻湧樓市長期來發展較慢的重要原因。叫停自建房雖然在短期內對麻湧的樓市不會有多大的帶動作用，但麻湧原住民有7萬多人，長期來看正面影響是必定的。深圳市天為房地產顧自存倉有限公司總經理李寶柱認為，麻湧原住民具有一定的購買力，停建自建房未來將成為麻湧房價上漲的一個誘因。麻湧樓市後市看好【延伸閱讀】麻湧樓市在全市處於發展較弱的區域，項目少、銷售慢、房價低，目前還處於“5字頭”。不過，受交通設施、區域規劃等帶動，麻湧樓市的發展潛力被業界所看好。麻湧樓市仍處起步階段由於經濟發展相對較弱，麻湧原住民大多住在自建房中，房地產發展較慢，市場容量不大，房價也較低，當前仍處於起步階段。當前項目較少，在售加待售的合計只有3個。今年前7月，一手住宅均價為5808元/平方米。據東莞中原市場研究部統計，2009—2012年間，除了2009年588套成交量以外，麻湧鎮每年的一手住宅成交套數均不到500套。去年成交量更是跌到197套，連熱銷鎮區一個月的成交量都不到。同時，麻湧的二手房市場也很冷清。麻湧鎮中心的一家房地產中介的負責人說，麻湧地區大部分戶籍村民都選擇自建房，較少關注二手房市場。而新莞人有能力的會去購買一手商品房，購買力相對較弱的則選擇租房。因此，政府在推地方面也很謹慎。從2007年開始到2011年，該地區平均每年推出不到1塊房地產開發用地（包括居住、商業、辦公、酒店等四類用地）。從去年開始，情況略有好轉，到今年8月20日為止，該地區共推出7塊房地產開發用地。東莞中原市場研究部相關負責人表示，從2008年至今，麻湧住宅購買力長期徘徊在3萬平方米左右，最高的2009年也不足6萬平方米。該地區樓市的不景氣也促使開發商在該地區拿地興趣略缺。從2007年至今所推的11塊房地產開放用地中，便有3塊用地慘遭流拍。發展後勁被認可據麻湧政府官網的數據顯示，麻湧鎮面積91平方公里，常住人口約11萬，其中戶籍人口7萬多，外來人口4.3萬。麻湧鎮位於廣州市與東莞市交界處，東距東莞市區22公里，西距廣州市區29公里，與廣州經濟技術開發區僅一河之隔。據規劃消息，未來幾年，涉及麻湧的西部快速幹線、沿江高速、珠三角城際輕軌等一批重大交通項目將會相繼建成。當前，東莞市政府正在推出水鄉片區開發，定位為全市經濟發展的三大新引擎之一，而麻湧正是水鄉片區一個重點鎮區。近年來，麻湧政府改善商業與工業結構，大力發展產業經濟，充分利用自身資源，完善港口配套設施，加大招商引資力度，促進當地工業經濟發展，使得工業用地成交十分搶眼。在此背景下，麻湧房地產發展後勁被業界肯定。東莞市房地產協會秘書長陳駿良說，麻湧樓市當前不會馬上有很大改觀，不過長期來看，發展潛力不錯。圖片說明:河左邊是麻湧在售的樓盤——大步海濱花園，河右邊是三四層樓高的私人房。; 麻湧鎮中心及附近區域，三四層樓高的私人房鱗次櫛比，而商品房項目卻屈指可數。迷你倉新蒲崗

Source: Asbury Park Press, N.存倉J.Aug. 27--RED BANK -- Taxpayers could be on the hook for $326,000 in payouts for unused sick and vacation time for five retiring borough employees, the second time in less than three years that the borough has had to borrow money to finance such cash-outs.Borough council members are scheduled to hold a public hearing and vote on a "severance" ordinance, which would authorize the payout and a resolution to go to the bond market at Wednesday's 6:30 p.m. meeting in borough hall. The payout plan was met with opposition from two Council candidates who say the borough should work with unions to stop the practice."That is for people who are retiring and we owe for payouts," Borough Chief Financial Officer Colleen Lapp said. "It's for accrued time, which could be sick or vacation time, depending on the individual."The payouts would be made to the retiring workers this year and the borough taxpayers would repay the borrowed $362,000, plus interest over five years, she said.This is the second time the borough has borrowed money to fund cashouts of unused sick and vacation time. The borough financed $750,000 over five years in November 2010 to fund payouts to 11 retiring borough employees.Those retirees began working for the borough prior to 1994 when regulations were changed to cap such pay-outs for unused sick time and other benefits for workers hired after that year, Mayor Pasquale "Pat" Menna said in an earlier interview.The five current retirees are "long-time" employees, Lapp said. Names, titles and years of service were not available from officials on Monday.The pay-out br迷你倉ught sharp criticism from Republican Council candidates Cindy Burnham and Sean DiSoma.Burnham said the borough should negotiate with unions to eliminate the payouts. She said the borough should also work with eligible employees, before they file retirement papers, to either reduce the amount of the payout or work out another arrangement to reduce the cost to taxpayers."See if they can take one day off a week. We want to decrease the payout or negotiate less money for those employees (to be paid on retirement)," Burnham said. "The borough policy should reflect what the majority of Red Bank taxpayers have at their own jobs in the private sector -- use it or lose it."DiSoma took a hard line."I do not really care about past agreements. That will be my first priority," he said. "No municipal employee who earns their living from taxpayers is entitled to hundreds of thousands of dollars in sick payouts. This practice needs to end immediately."DiSoma said he would seek a way to "close this loophole" through negotiations or changing the rules. He criticized the council for not addressing the issue since 1994.Democratic opponent and incumbent councilwomen Sharon Lee said the borough doesn't have many options because it is obligated to make the payments.
