花旗高層失340萬錶飾
港島四間豪宅前日遭夜盜爆竊後,迷你倉再揭跑馬地一間豪宅亦「中招」。花旗集團高層朱勇位於肇輝臺豪宅,前晚被竊匪潛入爆竊,房內一個入牆夾萬被撬毀,失去八隻百達翡麗(Patek Philippe)手錶及鑽飾等財物,總值逾三百萬元,其中一隻被偷名錶價值達一百四十萬元。警方接報到場調查,初步懷疑賊人由屋苑後山潛進大廈,再沿水渠爬上單位撬窗入內犯案。警方在後山檢獲一個載有約十萬元贓物的枕頭袋,疑竊賊忙亂間遺下,警方正追緝涉案匪徒歸案。探員爬上騰黃閣後面山坡調查及蒐證。(張曉楠攝)現場為肇輝臺七號騰黃閣一單位,為跑馬地區名廈之一。朱勇(五十八歲)為花旗集團董事總經理,負責該集團大中華區投資銀行業務。據悉,朱與妻子同住,並聘有一名傭人打理家務。檢枕頭袋 起贓十萬據土地註冊處資料,該單位於一○年以一千九百萬元購入,業主為朱勇及其一名姓桂親友。前晚十時許,朱與家人mini storage外返家,赫然發現屋內有搜掠痕�,其中一間房的窗門被撬開,房內一個入牆夾萬撬毀,存放在內一批財物失去,包括八隻約值三百萬元名錶、數隻鑽石戒指、一批金飾以及三萬元人民幣,總值約三百四十萬元,疑被賊人爆竊報警。警方到場調查,因屋苑後面貼近山坡,懷疑賊人經後山潛進屋苑,多名探員及鑑證科人員在場搜證,在山坡草叢中檢獲一個疑取自朱宅的枕頭袋,內�載�兩隻玉鐲、一條珍珠頸鏈及載有名錶證書錶盒等贓物,總值約十萬元,懷疑是賊人逃走時匆忙間留下,檢走調查。昨午三時許,十多名探員返回現場,並進入保安更亭翻看閉路電視片段,其後再攀上後山及前往被竊單位,作進一步調查。警方相信賊人趁單位住客外出,家傭放假,屋內無人潛入犯案,案件由灣仔警區刑事調查隊跟進。港島南區深水灣壽山村道兩個單位,跑馬地司徒拔道及山頂警署毗鄰山頂道共四個豪宅,前日分別揭發遭爆竊,損失合共近九十萬元。迷你倉

When investing in overseas property, follow trend with care
迷你倉 Hong Kong Monetary Authority (HKMA) entered a joint venture with a British developer in a mixed-use project of office, residential and retail spaces in Mayfair, west of London, adding another jewel to the crown on London's real estate. This is not the first time the HKMA is involved in property investment. Twelve years ago, it purchased 14 floors of the Two International Finance Centre (IFC), Central including its topmost floor with $3.7 billion, mainly for self use. As for purchasing property purely for investment, it started three years ago. The purpose was to boost returns through diversification of investment. Its investment tools expanded from traditional US debt and foreign currencies to real estate, bonds in emerging markets, private equity funds, etc. The HKMA's real estate investment was at first on a trial basis. It started taking big moves last year. Its real estate investment jumped by nearly four-fold from $3.4 billion to $16.4 billion in a year. Other than the Two IFC property for self use, the HKMA does not buy property in Hong Kong to avoid conflict of interest or being criticized for pushing up property prices. The 50-50 joint venture with a British developer involves around ?200 million in an area for office, retail and residential development above a London urban station. The HKMA spends about ?100 million (around HK$1.25 billion).Sovereign wealth fund loves London's property market The authority described London's property market as in great demand for Grade A offices and retail property no matter what market phase it is in. As the supply in the west is very limited, prices have been in a long-term uptrend. Hongkongers will inevitably associate that with the SAR's Central District. The HKMA is only one of those around the world who are optimistic about London's property market. Compared to Singapore's sovereign wealth fund GIC's acquisition of a 23-acre property cluster in a financial district from private equity fund Blackstone Group this August at ?1.7 billion (around HK$21 billion), the HKMA's investment accounts for less than its six percent. With market belief in US and UK property prices picking up, sovereign wealth funds from the oil-rich countries in the Middle East to Norway in Northern Europe all raised the proportion of property investment with Britain becoming the favourite of many sovereign wealth fund and private investments. After attracting a large number of wealthy Russians, London continues to attract a large number of the rich from emerging Asian economies. An accountant firm has estimated that one-fourth of Asian overseas property investment always goes to London, and it was even one-third last year.Not everyone can have HKMA's vision One of the reasons for London's property market being favoured is the convergent wealth effect as an international financial centre. The second reason is the supply being unable to meet the demand for high quality property on prime sites. The third is opening up to foreign funds. They form a vigorous and liquid market. Hong Kong satisfies similar conditions, hence it draws foreign investments, but recently the measures that the authorities have taken towards overseas buyers to curb property prices have given a message of going contrary to London to overseas investors. In recent days, response to the government's real estate tenders has been good, showing that property prices in prime areas are resistant against falling. But figures from the Rating and Valuation Department show that property prices are forming a top. Some Hongkongers who are used to investing in "bricks" will look for new channels of investment. Just as the European and US property markets are picking up from the trough, developers wave their hands at Hong Kong people. As the HKMA's investment in London's prime property comes to light with the investment being in a project that will be completed five years later, it further increases the interest of citizens in the property market there. But the HKMA's investment team chooses the best to invest in with its professional vision. This time, it stated clearly that a project that will appreciate in both rising and falling markets has been chosen. As for those overseas projects that are waving their hands at Hongkongers, some are good and some bad. 經濟和金融政策將進一步轉向偏緊
作者:周子勳11月9日,儲存中國已經進入了三中全會時間,同時國家統計局也如期公佈了最新一期的宏觀經濟數據。數據顯示,2013年10月CPI同比上漲3.2%,PPI同比下降1.5%,規模以上工業增加值同比實際增長10.3%,前10月固定資產投資同比名義增長20.1%,社會消費品零售總額同比實際增長11.2%。從已公佈的數據來看,經濟向好的趨勢仍在持續,主要經濟增長數據均大有起色。與上期相比,工業生產增長0.1個百分點,投資回落0.1個百分點,消費數據持平,這意味著經濟增長呈現企穩趨勢。價格數據也印證了相同的趨勢,隨著經濟逐步企穩回升,CPI和PPI總體態勢向上。圍繞最新的經濟數據,有兩個問題需要重點考慮。首先,中國經濟回暖勢頭能否持續;其次,未來的政策操作何去何從。經濟回升但外需尚未根本好轉對於當前中國經濟形勢,李克強總理的判斷是,經濟增長從二季度的7.5%提高到了三季度的7.8%,應該說是經濟回升了。CPI有所上漲,9月當月是3.1%,但一至三季度是2.5%,在3.5%左右控制的範圍之內。更重要的是,前三個季度城鎮新增就業超過了1000萬人,城鎮登記失業率在4.04%。三季度工業用電量增長了9.8%,鐵路貨運量也增長了7.3%,這與經濟增長是匹配的。他用“騎自行車”比喻“穩增長”政策:“你要是停著不動,沒准兒就會摔下來,所以還要動,要穩中求進、穩中有為。”李克強總理的這番講話透露出,中國經濟總體形勢向好。而10月PMI等數據表明經濟企穩的根基正在不斷夯實。國務院領導的表態實際上給今後的宏觀政策定了調:中國暫時不需要為經濟放緩擔心,可以騰出手來推動經濟轉型和結構調整。不過,當前中國經濟也有一些問題值得關注。首先,作為觀察全球市場動向的重要窗口,廣交會出口成交下滑顯示外需尚未根本好轉。11月4日閉幕的第114屆中國進出口商品交易會上,廣交會新聞發言人、中國對外貿易中心副主任劉建軍披露,本屆廣交會累計出口成交1946.1億元人民幣(折合316.9億美元)。相較於今年4月的春季交易會,成交額下滑明顯,環比下降達10.9%,與去年同期的秋交會相比,成交小幅下降3%。從地區來看,美國市場開始複蘇。在中國出口最主要的貿易伙伴歐盟、美國、日本、金磚國家和東盟中,美國是唯一增長的,較去年同期增幅超11%。值得注意的是,對以往一直是出口增長點的金磚國家的成交則出現較大幅度下滑,較去年和今年春季分別超過12%和17%的下滑。出口成交的下滑表明“外需尚未根本好轉”。從本屆廣交會到會採購商的情況也能反映出外需仍然“較冷”。多年來,廣交會一直保持20萬以上採購商的水平,今年減少至不足19萬人。產能過剩增加風險其次,近幾年房地產業迅猛發展、產能過剩正使中國的產業結構走向畸形。中央對此形勢的認識十分清楚,10月7日,國家主席習近平在出席亞太經合組織工商領迷你倉人峰會時表示,我們對需求下滑、產能過剩、地方債務、影子銀行等問題和挑戰保持著清醒認識,對外部環境可能帶來的衝擊高度關注,正在採取穩妥應對舉措,防患于未然。當前,中國治理產能過剩已成高壓態勢,而中央政府是絕對的推動者。不過,去產能過剩顯然不是件簡單的事情,由於化解產能過剩必將牽扯到企業關停並轉、兼並重組組合等,這必將出現參股、控股、資產收購等重大變更事項,這其中就可能涉及大量壞賬的產生。在當下的去產能過程中,被要求關閉的工廠可能通過資產重組和債務重組將更多債務和或有債務轉移進來,實際上,即使現有債務也相對已經非常龐大,銷售不暢情況要維持經營必然不斷推高負債。而在地方政府那裡也很無奈,本來就影響了財政收入,又要增加成本去產能作搬遷清理或改造,只會傾向于與企業一道把清理產能過剩的成本加到企業債務裡面,銀行的風險必然增加。從價格數據來看,正如美國《華爾街日報》所言,中國通脹上升意味著中國通過信貸渠道刺激經濟的效果在下降,中國內需增加的一個跡象,而這是經濟恢複平衡過程中的又一重要步驟。雖然從國際來看中國通脹似乎對全球經濟增長有利,從某種角度來看也有利於倒逼中國調結構改革,但是國內仍然需要警惕通脹上升的跡象。因為通貨膨脹水平上升、物價上漲對普通百姓生活會造成嚴重影響,它不僅是經濟問題,還有引發社會問題的風險。未來貨幣政策將向防風險傾斜事實上,日前央行發佈的《2013年第三季度貨幣政策執行報告》已經提出了警示。從央行報告看,防風險的傾向明顯。報告在分析當前中國經濟形勢時稱,綜合各方面情況看,未來一段時期中國經濟將保持平穩向好、穩中有進的態勢。但也必須看到,當前經濟運行中面臨不少風險和挑戰。新的強勁增長動力尚待形成,經濟可能將在較長時期經歷一個降杠杆和去產能的過程,房地產、地方政府性債務等問題比較突出,資源環境約束也明顯加大,結構調整和轉變發展方式的任務十分艱巨。消費價格平穩運行的基礎還不很穩固,物價對總需求變化比較敏感,要繼續引導、穩定好通脹預期。應該注意到,央行在報告中首次提及對房地產和地方債的憂慮,並一如既往地關注物價問題,相信這三項風險已經進入宏觀調控的視野範圍內。更為可慮的是,央行警示,降杠杆和去產能的過程將進行較長時間,這對中國經濟的韌性提出了挑戰。報告對下一階段主要政策思路的表述也值得關注。央行稱,引導商業銀行加強流動性和資產負債管理,做好各時點的流動性安排,合理安排資產負債總量和期限結構,提高流動性風險管理水平。這些措辭不難讓人聯想起今年6月的“錢荒”,以及不久前央行對商業銀行的類似提醒。結合近段時間央行在公開市場上的操作看,未來貨幣政策將向防風險傾斜。在宏觀經濟企穩、明年經濟增長目標可能下調的背景下,防範與化解房地產、地方債、產能過剩及通貨膨脹的風險,將成為央行的首要任務。總之,未來的經濟和金融政策將會進一步轉向偏緊。self storage

手指一劃板書即刻現身屏幕雨花區個性化學習創新模式將在全國推廣
本報訊(記者李卓實習生鄧紅)課堂上看不到一本書、一張紙,迷你倉師生人手一台平板電腦,手指輕劃,板書即刻現身電腦屏幕……無紙化、個性化學習的這一幕,昨日在雨花區長塘里小學、雅禮雨花中學、湖南省第二幼兒園、湖南長沙特殊教育學校同步展示。當日,由中央電化教育館主辦的2013全國新技術支持下的個性化學習高峰論壇在長舉行,雨花區展示的個性化學習創新模式將在全國推廣。iPad進課堂,師生有更多時間互動記者在長塘里小學鐘東平老師《平行四邊形的面積》一課上看到,鐘老師用手指在自己的平板電腦上一點,一個立體的平行四邊形,立刻出現在教室里的投影屏和每個學生的平板電腦上,免去了用粉筆和尺子畫圖的繁瑣。“互動性強,反饋及時。”鐘老師說,這一模式給她的最大感受就是鮮活互動。以往需要花大量時間寫字、畫圖,而現在只要輕輕一點,通過WIFI網絡,就全部呈現在屏幕上。師生可以有更多的時間互動,而且通過平板電腦還能夠馬上看到學生們課堂練習的正確率,這是傳統的紙質練習所不能比擬的。何謂新技術支持mini storage的個性化學習模式?據介紹,這種新的學習模式是基於雲環境下的移動化學習,手機、平板電腦等移動化終端被利用到教學上。在移動化學習的環境下,只要有無線城域網,教師就可以方便地將平板電腦、手機等終端上的教學資源展示在投影儀、白屏、電視機上,實現不同媒體終端的多屏互動。學生自主學習興趣提高了“這種新的學習模式,變傳統的‘聽講式’學習過程為‘參與式’學習過程,提高了學生自主學習的興趣和能力。”華中師範大學全國中小學計算機教育研究中心的李澤博士說。在該模式下,平板電腦其實就像一個“電子書包”,將教材、課外書進行信息化處理後,“裝”進了iPad終端載體。老師和學生可以根據自己的需要選擇相應的素材。此外,在雲環境下,教師可以利用平板電腦或者手機等終端,隨時隨地採集教學資源,將製作好的課件、視頻等素材上傳到移動終端上,學生和家長可以通過手機或者平板電腦獲取資源。當被問到更喜歡哪一種上課方式的時候,長塘里小學三年級的李銳說:“用iPad上課,這樣上課更好玩,還不用帶那麼多書。”儲存

Loophole lets officers facing discipline get duty disability, records show

As a result, he was fired from the department.But that didn't stop him from retiring on duty disability.Since his retirement took effect in June, the 40-year-old Copeland -- who didn't go to work for half his 14 years on the force and was disciplined two dozen times for misconduct -- has been paid more than $60,000, a figure that includes his salary and other compensation, records show. Checks for 75% of his officer's salary, tax-free, will likely keep coming for the rest of his life.Copeland exploited a loophole in the duty disability system, and the city, the Police Department and the civilian Fire and Police Commission are limited in what they can do to fix the problem, a Milwaukee Journal Sentinel investigation found.Because Copeland applied for duty disability before he was fired, his retirement took precedence over his dismissal. State law says the police union -- which represents the very workers accused of bilking the system -- would have to agree to any changes in the process as part of collective bargaining. And any fixes would not apply retroactively.Wisconsin's Act 10, which in 2011 curtailed most collective bargaining for most public workers, including the ability to negotiate pension terms, does not apply to police or firefighters.Gov. Scott Walker, who has been supported by the union representing Milwaukee police officers, has said he made that move because he did not want to disrupt public safety.Duty disability was designed to be a safety net for Milwaukee police and firefighters wounded on the job. But in recent years, an increasing number of officers suspected of misconduct have claimed debilitating stress -- sometimes even citing the department's investigation or media coverage as the cause of their stress.Copeland is among at least five officers to receive duty disability during or after a disciplinary investigation since 2006, according to city records. Applications are pending for another four.As of July, the city had paid $948,000 to the five former officers whose applications had been approved, according to the Employees' Retirement System, which administers the program. Because the former officers don't have to pay taxes on the money, their take-home pay is about the same as when they were working.Mayor Tom Barrett said such officers are "gaming the system.""I take it very personally when I see individuals who are, in essence, trying to take advantage of retirees and future retirees for their own benefit, and that's exactly what's going on here," he said.Ald. Michael Murphy, who sits on the city Pension Board and heads the Common Council's Finance and Personnel Committee, said the Copeland case is an example of how officers can abuse the system."I think it's a disgrace," he said. "At the end of the day, some of these people have no shame. I am grateful someone is finally putting some light on it."Milwaukee Police Association president Mike Crivello said his union is open to talking about the duty disability process but added the benefit must be preserved to care for officers who have to face "the horrific underbelly of society.""We welcome dialogue as to exploring the opportunity to better serve our members, thereby serving our community at the same time," he said.A long history of misconductCopeland, who was hired in 1999, has a long history of missing work and of breaking department rules, according to Fire and Police Commission and Police Department records.During his 14 years on the force, Copeland missed the equivalent of nearly seven years of work, according to records. Much of it was unpaid, but Copeland also began reporting workplace injuries and calling in sick regularly within months of his probationary period ending, records show.Throughout his career, Copeland was investigated for more than 40 violations and punished 25 times. He did not return calls for comment.He failed to file police reports regarding incidents to which he was dispatched -- for weeks, months or ever. And he was repeatedly written up for being late or failing to come to work without explanation.Police Department and Fire and Police Commission records document Copeland's history:--The first investigation came less than a year after Copeland was hired. While on duty and without telling the dispatcher, he went to the home of his children's mother and banged on the window. He received a five-day suspension that was later reduced to three days.--On Oct. 30, 2005, Copeland failed to file reports regarding nine separate complaints of property damage. Copeland said the homeowners did not want to prosecute, but they told a sergeant that was a lie. Another officer was sent to re-investigate the cases.Then-Chief Nannette Hegerty suspended Copeland for 10 days. The Fire and Police Commission overturned the punishment, saying there was not enough evidence to show Copeland and another officer failed to investigate the crimes.--In 2006, Copeland filed a worker's compensation claim citing stress, which was rejected by the city.--In 2011, Copeland was punished for failing to answer a dispatcher's repeated calls because he was arguing with his ex-girlfriend, who was driving a school bus at the time.Copeland pulled his squad car in front of the bus and confronted the woman, hitting her through an open window. During the quarrel, the dispatcher called Copeland's police radio five times, asking him to check the welfare of a resident.The incident resulted in a 10-day suspension, which was upheld by the commission.Board can't challenge claimsAs the most recent disciplinary case against him unfolded, Copeland began to lay the groundwork for his duty disability retirement, claiming, in part, stress over being investigated.The first thing Copeland did was file a worker's compensation form directly with the city's benefits department, in violation of a police rule that he notify his lieutenant first.Officers must file for worker's compensation before they can seek duty disability.On the worker's comp form, Copeland claimed he suffered a shoulder injury while making an arrest as well as stress to his "body and mind" because of the misconduct investigations, records show.Copeland had filed worker's compensation forms six times before, each time following the proper procedure and reporting his injury claims first to his supervisor, according to records.When an internal affairs investigator asked why he disregarded the rules with his most recent application, Copeland lied, records show. He said a disability specialist with the city told him to file his claim there instead of at the department. He also said he had notified his lieutenant of the injury. Both officials denied such conversations took place, according to records.Despite the investigation and findings by internal affairs, the city accepted Copeland's application for duty disability.On March 13, Police Chief Edward Flynn fired Copeland for lying during the investigation into his injury claim. But because Copeland filed for duty disability before being fired, his dismissal didn't stop the processing of his duty disability claim.Under the collective bargaining agreement between the union and the city, here's how the process works:To submit a claim, officers must confirm their personal physician has certified them incapacitated because of an on-the-job injury.After officers file a claim, they are examined by more doctors. For officers hired before 2006, one doctor is chosen by the union and one is chosen by the city. If they disagree -- as they almost always do -- the doctors agree on a third doctor to break the tie. Officers hired since 2006 who claim a stress-related disability are evaluated by a different three-doctor panel appointed by the Employees' Retirement System.In Copeland's case, psychiatrist Victoria Fetter was listed as his personal physician certifying his stress.She said in an interview that she saw Copeland a few times and then sent him to a different doctor for evaluation. Fetter said she couldn't be sure of Copeland's claim and was surprised to learn she was listed on the disability statement as certifying his condition."It was really difficult and complicated and I had no way of verifying what he was saying," Fetter said.After he applied for duty disability, Copeland was seen by two doctors -- James Winston, hired by the union, who found that Copeland should be approved, and Donald Feinsilver, the city doctor, who said he should not.A third psychiatrist, Dinshah Gagrat, broke the tie in favor of Copeland getting the disability retirement and sent that recommendation to the city's Annuity and Pension Board.Those three doctors either did not return calls or declined to comment.The board approved the disability retirement three months later.Board members have virtually no authority to challenge disability claims brought by officers accused of misconduct, according to a 2003 city attorney's opinion.The city charter "requires the Board to grant a duty disability retirement when the medical panel issues its final recommendation that certifies that the applicant is eligible for a disability retirement," the city attorney's opinion states.If the board were to go against the doctors' recommendation, the city could be liable in a civil rights lawsuit, according to the opinion. The city also likely would face court challenges if it tried to change the charter to give the board discretion, the opinion says.Systems have different rulesDuty disability payments are made via the city's $4.8 billion retirement trust. The city and current employees contribute to the trust account, which funds pensions for all retired city employees, not just police and not just those with disabilities.This year, the city's contribution to the fund was $62 million, according to the retirement system. Retirees, including police on duty disability, don't pay into the fund. Their pensions are funded with investment returns.When it comes to stress, the standard for receiving duty disability is far lower than the standard for receiving worker's compensation, a statewide program for employees who suffer work-related injuries.To rec迷你倉ive stress-related benefits under worker's comp, an employee must suffer "unusual stress," according to a state Supreme Court decision. Unusual stress is stress above and beyond what one would expect from a particular job. Because police work is a paramilitary job involving crime and violence, officers know going in that they will likely be subject to a fairly high degree of psychological pressure. As a result, officers can prove exceptional stress only rarely.That concept does not exist under the city duty disability program. To receive disability benefits, officers must certify only that their stress was a "natural and proximate" result of doing the job and it was not caused by their own negligence, according to the city charter, which governs the Employees' Retirement System.Because of the different standards, officers denied worker's compensation can turn to duty disability and prevail.The city attorney's office is reviewing whether the duty disability criteria could be changed to match the "unusual stress" standard of worker's comp, city officials said.Another fix could be for the city not to accept the applications of officers under investigation, according to Flynn.He said: "I don't believe it takes an ordinance or a law change to say, 'Here's a concept: When somebody files for disability, we're going to ask the Police Department if they're currently under investigation for any misconduct. And if they are, we're going to suspend considering the application. We're not going to accept it. We will not accept application from people under investigation. All right? Period.'"The city attorney's office is researching options but has not issued an opinion about whether that procedure could be adopted.Flynn said that until recently, the department was not even informed when officers applied for the benefit, let alone asked whether an officer's claims of stress were valid."That is the biggest gaping hole in this whole process," he said. "I mean, how in the name of God can we not be in a position to fact-check assertions made in a pension that is going to be worth millions of dollars? It just makes no sense at all. It defies logic. It defies sensible stewardship."An opinion written last year changed long-standing policy and allowed the Employees' Retirement System to share applications with the Police Department, even if the employees object. Because it is a city agency, the Police Department also could help verify the information on the applications, according to the opinion."In our judgment, providing a copy of the application for duty disability retirement to the city department that employs the applicant so that relevant information can be provided in a timely fashion, and so that the application for duty disability can be processed more expeditiously, would be deemed a necessary function of ERS's responsibility," the opinion says.The pension board has been routinely supplying the Police Department with all applications since September, city officials said.Not a singular caseIn the past seven years, at least five officers have received duty disability payments from the trust during or after a disciplinary investigation, including Jason Mucha, who supervised four officers later charged in connection with illegal strip-searches. Mucha, who was not charged or disciplined, claimed stress over investigations into his conduct and media coverage.Mucha recently reclaimed nine guns taken from him as part of an emergency mental health detention.The duty disability application of Detective Rodolfo Gomez Jr., charged last month with felony misconduct in public office on allegations of hitting a handcuffed prisoner, is pending.Gomez's application for the benefit, filed after internal affairs sent the case to the district attorney's office, says he suffered a mental breakdown as a result of 31/2 years spent investigating the murders of nine children -- as well as the death of a pregnant woman whose fetus was cut from her womb, killing them both.Even if Gomez is fired, he can slip through the same loophole used by Copeland and be approved for stress-related duty disability because he filed his application before any disciplinary action was taken.Gomez and other officers accused of misconduct received help with their applications from Bradley DeBraska, according to documents filed with the retirement system. DeBraska is a former Milwaukee officer and police union president who was convicted of a felony for forging a document in the union's high-stakes legal fight with the city over the officers' pension fund.DeBraska, a former Pension Board member, has been working as a paid consultant for the Milwaukee Police Supervisors' Organization since at least March 2012. He did not return calls for comment.DeBraska also assisted in the application of Anthony Bialecki, who cited his shooting of an unarmed man in 2009 as the cause of his stress.Bialecki filed for duty disability in June, four years after the shooting -- but two weeks after he was charged with a misdemeanor for buying Percocet without a prescription.Bialecki was hired as a police officer in 2001 and had been disciplined twice -- once for sexual harassment and once for failure to appear in court -- before being criminally charged in May, according to records.In January 2009, Bialecki fatally shot an unarmed man, 26-year-old Domonick Washington, who was the passenger in a car. Bialecki told investigators that as he and his partner approached the car during a traffic stop, Washington's movements led them to believe he was trying to hide drugs. As they searched Washington, he struggled and tried to run away.Washington punched and kicked the officers, according to police reports. Bialecki told investigators he shot Washington at close range in the chest because he appeared to be reaching for his waistband. Bialecki said he feared Washington had a gun.Marijuana was later found in the car.The driver, Deanna Abbott, told police she saw the officers punch Washington, according to police reports. She said Washington was on the ground and Bialecki was on top of him when the fatal shot was fired. Afterward, an officer pointed a gun at her and told her to stay put, she said.The shooting was ruled self-defense. Bialecki was not disciplined or criminally charged, and he was returned to full duty. A few months later, he injured his shoulder while chasing a suspect, according to court records.In February, Bialecki was caught illegally buying 20 Percocet pills from a police informant. When questioned by internal affairs, Bialecki said he had purchased the painkillers to supplement his prescription for Vicodin, which he was taking for his shoulder, according to court records.Last month, Bialecki, 38, pleaded no contest to a misdemeanor charge and was fined $500. But the conviction did not derail his bid for duty disability. The union doctor said he deserved it and the city doctor said he did not. Last week, the third doctor agreed he was eligible.His case is scheduled to come before the pension board for final approval Nov. 25.Bialecki's attorney, Steven McGaver, did not return calls for comment.In a sentencing memo filed in the criminal case, McGaver said Bialecki was diagnosed with post-traumatic stress disorder after he shot Washington. The shoulder injury made Bialecki's psychological problems worse, McGaver wrote."Both of these conditions resulted in a change of Anthony's personality to becoming more withdrawn from his personal relationships, hypersensitive to his surroundings and frustrated with being unable to maintain his life as he once knew it to be," McGaver wrote. "...Anthony is truly remorseful for his actions that led to his arrest and has taken a lot of time to contemplate the negative choices he has made and the impact those choices have had on his family, friends and professional goals."Audit of system underwayAn audit of the duty disability system, requested by Murphy, is underway. It is expected to take three months.At the state level, Sen. Tim Carpenter (D-Milwaukee) introduced two bills that could close the loophole. The first, known as the Act 10 Equity Bill, would require public safety unions in Milwaukee to be treated the same as other city workers, eliminating their ability to bargain on pension.The second bill would remove the Milwaukee Police Association's ability to take a single issue to arbitration. That means the union could no longer challenge the city on one part of the contract without risking other provisions supported by officers. The Wisconsin Professional Police Association, which represents most officers throughout the state, does not have the ability to take a single issue to arbitration.Carpenter said he supports police and firefighters and would like to see collective bargaining restored for all public workers. However, he said he finds it frustrating that the police union is using its power to protect corrupt officers who instead should be weeded out of the system."Right now, the City of Milwaukee is handcuffed. We can't do anything to protect taxpayers," he said. "The City of Milwaukee is basically stuck with the duty disability issue because the city can't negotiate with the police union -- it has such a strategic advantage over the taxpayers."Carpenter's bills, however, are unlikely to become law, considering they have no support from Republicans, who control both chambers of the Legislature and the governor's office. Both have been referred to the Senate Committee on Judiciary and Labor. Sen. Glenn Grothman (R-West Bend), who chairs the committee, said he is reviewing the bills."I always consider myself a friend to Milwaukee and will consider having a hearing," he said.If the Legislature has not passed reforms by the end of the session in April, Carpenter said he plans to ask for a state audit or a legislative council committee to address the issue further."I fully expect they are going to find people abusing the duty disability statutes and taking advantage of it," he said of the auditors.
