Both required surgery for their injuries, the affidavit said. A hospital spokeswoman said that two gunshot victims were treated Friday morning but could not release additional information because of patient privacy laws.On Christmas afternoon, one man was shot during a fight in an apartment in Building 312, police said. Tyrone Scott, 34, of North Empire Court, faces multiple charges for shooting his cousin, Nathan Scott, police said. The privately owned complex off Coal Street that provides low-income housing has been the site of numerous shootings and arrests in recent years. The U.S. Department of Housing and Urban Development called its management unsatisfactory last month after inspecting the property.A task force of civic, local, state and federal officials joined with the city in attributing the problems at the complex to lax oversight.Representatives of the owner, Sherman Hills Realty of New York City, and its manager, Park Management of Brooklyn, N.Y., presented a plan to improve security at the complex thamini storage included installing a fence and a gate at the entrance, improving the lighting and camera surveillance system and hiring an armed guard to patrol the property for 10 to 12 hours a day.A Sherman Hills manager confirmed Thomas lived at the complex with a small child, but Thomas refused to allow police to search her apartment, saying the gun, a .380-caliber handgun, was "ditched." That prompted police to obtain a search warrant.According to the warrant: A detective from the Newark (N.J.) Police Department called city police to notify them two people were being treated in the emergency room at East Orange General Hospital for gunshot wounds. Newark police provided the names of Burgman and Thomas and said the pair told them the accidental shooting occurred in Thomas' apartment.Wilkes-Barre Detective David Sobocinski called the hospital and independently spoke to Burgman and Thomas.Burgman said the gun discharged as he pulled it from his waistband. He said he bought the gun at a local bar from an unknown guy and was unsure where the gun was.Thomas told the detective that she was lying on top of Burgman when the gun went off. She added that no one else was in the apartment and no one else was struck.Sobocinski sought the search warrant that was approved by District Judge Martin Kane to retrieve evidence in furtherance of the investigation of the charge of recklessly endangering another person and to determine that every one involved was located and treated.Copyright: ___ (c)2013 The Times Leader (Wilkes-Barre, Pa.)
